911 Limitations of Liability
ANA Telecom Services Ltd. (ANA Technology) supplies VoIP (Voice over Internet Protocol) services that allow you to make or receive telephone calls over the Internet to or from the public switched telephone network. This service is not able to support E911 dialing or access emergency services in the same way as traditional telephone services. Please read the following carefully.
Upon accepting the terms outlined herein, you are acknowledging and indicating you understand that ANA Telecom Services Ltd. (ANA Technology) VoIP telephone service does not support traditional 911 access to emergency services. The VoIP (Voice over Internet Protocol) service appears to be similar to traditional telephone call services, however, it does create limitations that are specific to VoIP services, and by accepting the terms outlined herein you are accepting and agreeing to the differences between traditional telephone services and VoIP telephone services, which include the differences from traditional 911 emergency calls.
By using this service, you are agreeing to notify all residents, employees, temporary guests, and all other potential users that may be at the location in which these services are available of the limitations and differences regarding 9-1-1 emergency calls. It is important that all users of the VoIP services are aware and understand how the differences may impact your access to 911 and E911 services.
When a 9-1-1 call is made using the VoIP services, the service will attempt to automatically route the call, through a third-party service provider, to the local emergency service that corresponds to the address that you have recorded in your account. Although, due to the limitations of the VoIP services it may be routed to a different location than that which would be used for a traditional 911 call with automatically generated address information. The VoIP service will attempt to automatically provide the emergency service operator with the name, phone number, and address associated with the account. However, due to technical issues, the operator may not be able to retrieve or access your information. When using VoIP services 911, it is very important that you immediately provide the operator with your name, address, and phone number. It is important that you do not disconnect the 9-1-1 call until told to do so by the dispatcher because it is possible that the dispatcher does not have your number or contact information. If you are disconnected for any reason, you must call back immediately.
You are responsible for providing, maintaining, and updating the correct contact information for each phone line with your account. Upon activation of service, each phone line will be registered with the physical location where that line will be used. If there are any changes in locations, transfers, or new additions regarding phone numbers and equipment it is your responsibility to update these changes with ANA Telecom Services Ltd. (ANA Technology) and confirm that your physical address is correct on your online account. Due to 911 dialing services, only one address at a time may be registered for each phone line. If your equipment is moved even temporarily or short term to a different address or location that varies from the most recent information provided to ANA Telecom Services Ltd. (ANA Technology) you must inform ANA Telecom Services Ltd. (ANA Technology) of the change and confirm that the address is correct on the online account.
If you do not have the correct location, if your account information has changed recently, or for any other reason has not been updated, 9-1-1 calls may be misdirected to an incorrect emergency response site. In the event that you are unable to speak, the emergency personnel may not be able to establish your location if your address information is not up to date. Upon accepting these terms, you are agreeing to authorize ANA Telecom Services Ltd. (ANA Technology) to disclose your name and address to any third parties that are involved in providing 911 services these may include, without any limitations, call centers, call routing services, and local emergency services.
Due to possible network problems, network overload, or due to other technical issues, you acknowledge that it may be possible that a 9-1-1 emergency call will receive a busy signal, be dropped, or be delayed in connecting, when compared to traditional 911 calls over traditional telephone networks.
You acknowledge that you understand that any service outage, for any reason, including but not limited to billing issue disconnection of service, will terminate the availability of ALL services, including 9-1-1 services. You acknowledge and agree that in you understand in the event of a power outage or loss of internet connection ALL service, including 911 services will be unavailable. You acknowledge that you understand that in the event of power failure, network or internet outage it may also be necessary for you to reset or reconfigure the VoIP equipment in order to re-connect and restore access to 911 services.
ANA Telecom Services Ltd. (ANA Technology) does not have control over how 911 calls are answered, directed, or handled by any emergency response centre and relies completely on third parties for routing and directing 911 calls to emergency response centres.
In no case shall ANA Telecom Services Ltd. (ANA Technology), its affiliates, officers, directors, employees, agents, or any third-party provider be held liable to the customer, any user of the VoIP services, or other parties for any claim, damage, or loss, including any damages as a result of service outage, data loss, and the Customer hereby waives any and all such claims or causes of action, arising from or in relation to 911 dialing.
By accepting these Terms and Conditions, you are confirming that you have read, understood, and agree to this 911 disclosure and that you understand that when using VoIP services, you may not be able to access emergency services by dialing 911. You are also confirming that you understand that it is your responsibility, and you must inform any users of the VoIP services that they may not be able to access emergency services by dialing 911 when using VoIP services.
By accepting, you, the customer, are agreeing to defend, indemnify, and hold harmless ANA Telecom Services Ltd. (ANA Technology), its affiliates, officers, directors, employees, agents, or any third-party service provider that offers services to ANA Telecom Services Ltd. (ANA Technology) in relation to the current agreement or service being provided, from any and all claims, losses, damages, fines, penalties, costs, expenses, legal fees, etc., by, or on behalf of, the Customer, any third party or user of the Customers’ service arising from their use or attempted use of VoIP services including absence, failure, or outage of the service, including 911 dialing and/or inability of the Customer or any third party or user of their service to be able to dial 911, or to have access to emergency service personnel, as well as any misdirection of 911 calls.
SECTION 1 – USING OUR PRODUCTS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. In the event that we make a change to or cancel a request, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the request was made. We reserve the right to limit or prohibit requests that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. You agree to provide current, complete, and accurate account information for all the orders requested at our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Section 10 – VOIP Services
When customers call Ana to request activation of their VoIP service, Ana’s representative will notify them of the documents in the starter kit and how the VoIP emergency 9-1-1 services differ from traditional 9-1-1 services. Once their VoIP service is ready to be activated, customers will, through the Internet, log onto their account management site to activate their 9-1-1 service.
